§ 1 Scope
These General Terms and Conditions apply to all orders placed via the online shop hntr-legend.de between [Name or company], [Street and number], [Postcode and city] (hereinafter “we”) and our customers. We do not accept deviating terms unless we expressly agree to their validity.
§ 2 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the “Place order” button (“Jetzt zahlungspflichtig bestellen”), you submit a binding order for the goods in your cart. The acknowledgement of receipt of your order is sent by e-mail immediately afterwards and does not yet constitute acceptance. The contract is concluded when we accept your order by a separate e-mail (order confirmation) or by shipping the goods. For prepayment, we accept the order with the order confirmation containing our bank details.
Before submitting your order, you can correct your entries at any time using the usual keyboard and mouse functions. All entries are displayed again in an overview before the binding order.
§ 3 Language and contract text
The contract language is German. English translations are for information only. We store the contract text and send you the order data and these terms by e-mail. You can view these terms on this page at any time.
§ 4 Prices and shipping costs
All prices are final prices. In accordance with Section 19 of the German VAT Act (UStG), no VAT is charged. Shipping costs may apply in addition and are clearly shown before you place your order. See Shipping & Payment for details.
§ 5 Delivery
We deliver within Germany. The delivery time is stated on the product page and under “Shipping & Payment”. If an ordered product is unexpectedly unavailable, we will inform you without delay and refund any payments already made.
§ 6 Payment
The available payment methods are shown during checkout and under “Shipping & Payment”. For prepayment, the purchase price must be transferred within 7 days of conclusion of the contract. For purchase on invoice via PayPal, the payment terms of PayPal/Ratepay apply (payment to PayPal within 30 days).
§ 7 Retention of title
The goods remain our property until paid in full.
§ 8 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the withdrawal instructions. You can also declare your withdrawal online using the “Withdraw from contract” button.
§ 9 Warranty
Statutory warranty rights apply. For entrepreneurs, the limitation period for claims for defects is one year from delivery of the goods; this does not apply to claims for damages.
§ 10 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely), our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
§ 11 Notes on use
The case protects a long gun from moisture, dirt and scratches. It is water-repellent but not waterproof and open by design. It does not replace the storage required by the German Weapons Act; the user is solely responsible for the lawful transport and storage of weapons. Always insert weapons unloaded.
§ 12 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state of their habitual residence. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
